Mediation is the best process we have to resolve disputes. It works best when the parties know they have been clearly heard by the neutral, and they have clearly heard the risks and difficulties they face. I structure the process so that all parties hear a point-counter point presentation of the issues in the case. This process takes off the table issues that are not in dispute or are not material to resolution. When the parties themselves hear for themselves the strengths and weaknesses of their case we usually can move forward to resolution. Finally, I find that many disputes have an emotional component, even disputes between sophisticated business executives. We are much more likely to reach resolution if, in private session, we are able to articulate the emotional issues and address them.

Biography

Hon. Eli Chernow (Ret.) is a well recognized and highly respected neutral in Southern California. He has successfully settled thousands of cases over the last 30 years, largely in part due to his sharp wit and his abilities to organize amongst chaos and embrace emotional situations.

He describes himself as highly analytical and well equipped to handle emotionally charged cases, and is respectful to the parties, issues and attorneys while guiding them to an equitable resolution. Judge Chernow is experienced in resolving cases in almost every area of law, including business/commercial, family law and probate.
 
He has lectured frequently for many bar associations and other organizations, Judge Chernow is the co-author of The Rutter Group’s California Practice Guide: Civil Trial & Evidence, and has published numerous articles on such topics as sanctions and expert witnesses. He is a former associate professor of law at U.S.C. Law Center, where he taught courses on evidence, corporations and environmental law.

Judge Chernow was appointed to the Los Angeles Superior Court in 1977, where he served until 1993, and is among California’s most lauded retired judges. Judge Chernow earned his B.S. in 1961 from the California Institute of Technology, and in 1964 graduated from Harvard Law School, Magna Cum Laude. He was the editor of the Harvard Law Review from 1962-1964 and was a Frederick Sheldon Traveling Fellow for 1964-1965.
